What is legal process to remove mechanic's lien in CA? Lien placed on house 1 yr. ago, but never foreclosed.

  • Contractor did shoddy work. I had to fire them, and get someone else to complete the job. I offered to pay the contractor the original agreed amount minus what I paid the other guys to finish the job. They refused and filed a mechanic's lien on my house instead. That was 1 yr. ago. If I understand correctly, in California, the contractor must foreclose the lien within 60 (?) days otherwise the lien becomes invalid. They did not foreclose. What are the legal steps for removing this lien? How much should I expect to pay a lawyer for doing this? Thanks!

    You need to move the court to expunge the lien. Go to courtinfo.ca.gov and click on the self-help link. Also, go to your county's superior court web site and see about their self-help section. You may be able to do it on your own. If you have any attorney friends or family, they can probably help you do it. It shouldn't take too much of their time.
