What is CA unemployment?

What remedy do I have against employer for paying Unemployment to wrong state?

  • I worked for a large construction staffing company on a year long project in CA and was laid off. I filed for CA unemployment (I lived and worked in CA and was not hired as a traveling employee) and received a benefit award of $0 because I had no reported wages in CA. Turns out my former employer pays unemployment insurance for ALL its employees in NV, regardless of actual work location. I was never advised of this, and taxes on my first week's wages were paid in CA for some unknown reason. I believe CA Unemployment will eventually get me paid, but it's already been 6 weeks, and the issue is still weeks from being resolved. In the meantime, I have absolutely no income and my finances are a mess. Do I have any basis to sue my employer?

    Likely none. The state of California has a claim against them but you don't.

I'm in Philly and our area divides work with PA residents and NJ resident. Look at our bridges during rush hour and 2/3rds go from Jersey to PA, while 1/3rd is going form PA to Jersey. Obviously the two states swap unemployment money constantly. You're right, it's the employer responsible for paying the unemployment office for you. Likewise, it's the unemployment office responsible for making sure that's done. Talk to unemployment about the problem. You certainly don't want to piss off the hand that's feeding you - quite literally. (Your ex-employer.)

Sounds like you should have applied for unemployment in NV. What did they tell you when you did that? You have done that,right?
