Encrypted Data vs Copyright Infringement?
-
I have a hypothetical grey area question: If you were to look at each item in isolation, it doesn't violate any laws if made publicly available... -An Encipherment process -An instance of a Cipherkey -An instance of a Ciphertext Let's propose the Cipherkey was a public News article, and the cipher was something I developed. Now let's also propose the original source was of copyrighted material. Assuming permission was not granted and yet no direct copy was made. In which combination and at what point would copyright infringement occur? At which point does the random noise of a ciphertext become more than face value?

Answer:
One of the slippery aspects of law is intent. You cross the line when you do something with a product that is against the creators wishes.
