Is it illegal to burn videos from youtube on dvd-r's and sell them?

Hi. I was at the flea market last weekend, and a guy was doing a brisk business selling dvds that he had burned. The dvds had hundreds of youtube videos on them. Is this legal? I was talking with him, and he said that the software to download the videos from youtube was available on the web. He was charging $10 per disc, and said he was selling 100+ a day, and from what I saw this looked true. He said a cop who worked at the flea market was even a customer. So is this legal? Could he get in trouble criminally or sued in civil court? He didn't have obvious copyrighted stuff that you sometimes find on youtube, like major movies, or music videos. Mostly it was people's personal videos.

Any work, as soon as it is created, is copyrighted as a matter of law. You do not need to register a copyright (in the United States) in order to have an enforceable right against unauthorized use. YouTube terms of use probably involve transferring the copyright interest to them (or at least a right to use & publish the work). Yes, this is unlawful, and the creators of the videos can sue to stop this guy from selling DVDs. YouTube likely would have the right to sue as well. Either party could possibly recover damages as well.

personal videos are just as copyrighted as anything else. so do the math.

Well, the videos probably aren't copyrighted since they are just posted by members, so it could be legal. But it sounds a bit strange.
