Can I be fired from corporate without notice?

Replaced/Fired Without Notice?? Is this even legal?

  • My brother was recently hired as a dishwasher in a restaurant and he has been working there for about three weeks. Last Saturday when he went to work, all the doors to the restaurant were locked. He phoned immediately and the waitress said that the restaurant was closed for a private function and he wasn't needed. Today he went to the restaurant and began to prepare for work when one of the chefs told him to phone the manager. The manager said that he was replaced because he didn't show up for work on Saturday when he was needed and my brother explained that he DID show up for work but all the doors were locked and he even phoned explaining he is one of the dishwashers. The manager said that my brother was pretty much fired. He went on further saying that he "isn't the type to give prior notices". (Like what the heck??) So my question is this: Is the manager legally able to fire and replace someone without giving any notice especially when it isn't the person's fault? What should my brother do about this situation? This is really upsetting as it was his very first job and he did like the other people that he worked with. The manager is a big bum head in my opinion! >:O

  • Answer:

No notice is required for termination within the first three month of employment under the B.C. Employment Standards Act.

yes, it is legal.

It's legal, and it is his fault. If one has a work problem, one should ask *the boss*. (Not some random coworker.) What he should do is learn from this mistake before he gets another job. The boss is in charge, and workers take direction directly from him or her. Only.

In a right to work state with no union? The employer can fire him for pretty much any reason he wants, without any notice.
