Help I am being sued! Can my neighbor do this?

Today received some paperwork from this attorney stating that my neighbor is suing me. Apparently her son who has a peanut allergy went into anaphylaxis after eating a Fun Size Snicker bar. She is stating that I gave her son the snickers on Halloween. She is suing me for the medical bills plus pain and suffering!! Does she have a case?

Go for self-defence. I'm assuming this event happened during Halloween. Well, it is obvious that you were placed in a position of protecting your property as well as your family. I would expect the little monster greeted you at YOUR door with the common extortion line of "Trick or Treat". An obvious threat to you that if you didn't satisfy his demands, he would retaliate with either violence or destruction of your property. Nay, you could have well planted razors in his apple with justification. If the no-neck mutant hasn't got the sense not to eat peanuts, that's not on you. Maybe just shoot him next time he stumbles by your house.

So what you're telling me is that her son unlawfully entered your premises and took, without your knowledge or consent, an item that may or may not have been a Fun Size Snicker bar. Also....Is it true that your neighbor's husband was convicted of a DUI in 1999?

Of course not. You gave him a common retail product. You are not responsible for determining if he will react to it unless you held him down and forced the bar into his mouth. Any mother who sent a kid out for T&T without telling him what he could or could not eat is a moron.

Hmm this must be why NONE of my neighbors were handing out candy. Fortunately for me I don't give out any of the good stuff, only candy from the dollar store.

It seems that this neighbor is really reaching. If she sends a child out on Halloween, she should expect to have various snacks and candies put into the child's sack. If she knew of a food allergy, she could have controlled the situation by supervising the child. Since you are being sued, however, contact your attorney as soon as possible. If you do not have an attorney, use the state bar's lawyer referral service.
