I am interested in finding out the liability of having a uncertified police officer working for a agency?
-
The officer in question is working regular tours unsupervised and the officers working with him are leary do to the liability we believe. Our Chief and town say the uncerified police officer can work and he has one year to go to the police academy. We feel he should be riding along with a field training fficer not by himself enforcining the laws of the state of new york any information or case law would be gratly appreciated.

Answer:
Don't bother with the media. Don't bother with looking for case law. Spend a few minutes looking around the New York Department of Criminal Justice DCJS Office of Public Safety website at: http://criminaljustice.state.ny.us/ops/index.htm And get yourself an education. It could be that what you're describing is perfectly proper within your state. If it is, but you still don't think this officer should be working unsupervised, contact the chief of police with your concerns. Some would suggest that if the chief does not satisfy your frustrations you should go to the governing body for your city (city council, etc), but I don't know how useful that would be. They will only know what you tell them and what the chief tells them, and who do you think they will believe in the long run? If talking to the chief doesn't changes things, I guess it would be best to tell the chief that are you concerned enough that you will take the issue public and will speak with the City Council. If you actually do that, and see no changes, then I'd say the media is a fair bet. I'd check out the website first. Then I'd talk to the chief if I was still concerned.
