What's the scoop on midi copyrights and paid performances?

There are many midi arrangements out there for free download. Can these files be used for live performance? I see some warnings about copyrights for the arrangement but don't these music arrangers first have to secure permission from the songwriter to even put them out in the net? It is very confusing! Does anyone actually get sued for using these midi files in a paid live performance?

Answer:
If the arrangement of notes resembles the song, then they have to secure copyright permission. Most midi composers are probably blatantly violating copyright because it is not likely to be prosecuted.
