Can my employer use lie detector or not? what about the law?

Why does the NYS AG's office defend court employees on one side for free, but the other side has to spend $$$?

  • NYS Court employees in Nassau County who are discriminated against, harassed & retaliated against, can not get a fair forum in which to fight for their rights & justice. Good employees, with many years of unblemished service, who are targeted by their all-empowered supervisors, are being harassed to death. Those that choose to speak up & try to fight back have their jobs threatened directly or indirectly. Performance Evaluations are manipulated; time sheet fraud is overlooked; drinking on the job is overlooked, as long as you're the one running the courthouse - - which is currently the case for one person "in charge." Potential witnesses who might help an aggrieved employee are threatened, one declaring openly, "I'll lie under oath if you put me on the stand." The supervisors are in with management; the Union (COBANC) is in with management. The Union President said, "They're just like the cops, they all stick together." The 1st VP said to a harassed female, "Would you feel better if I told you this kind of thing goes on all over?" The State, despite the budget crisis - - in this case, namely OCA, Office of Court Administration - - refuses to look at situations impartially, with a hope to getting to the truth, & instead spends much taxpayer money to prosecute & persecute good employees who have corrupt, abusive, power-hungry supervisors who have their own agenda. In a couple of recent cases, the State sent in attorneys, paid a small fortune for huge transcripts for Administrative Hrgs. that went on for many months, hired a Hearing Examiner - - albeit not an impartial one - - all to go through a sham hrg., since the outcome was a foregone conclusion. As one respected attorney put it, "You're always before your employer." So, in a court of law, where justice is supposed to be blind, there is no justice. The powers that be throw the weight of the NYS AG's office around, knowing they'll just come in FOR FREE & do their dirty work. Many attorneys don't want to go up against the almighty court system. It is truly a monopoly of the worst kind. Yet the corruption is evident if the right people would only look. In one instance, a court officer committing egregious time fraud was moonlighting as a security guard at Shea Stadium......proof.....nobody cares.....he's in with a top judge. In another instance, a supervisor violently ripped a state clock off the wall over an employee's desk, scattering debris.....proof....nobody cares. In another instance, a judge was recruited by management - - a "hired gun" - - what was HE promised to completely fabricate a scenario in his courtroom & lie through his teeth about an employee who had worked for over 100 judges over 20+ yrs. with never a complaint, but rather praise for a job well done? In some cases, when employees were told to "speak up," they then got yelled at in a meeting by the very person who was supposed to assist them. They were told if they didn't like it, "there's the door," & that he'd be "sitting in the parking lot in his big black Lexus" watching everyone. One supervisor said, "Don't put anything in writing." The Union said, "Don't use the word 'harassment.'" One judge, in confidence, said, "What they're allowing to happen in this courthouse is terrible; they're allowing him (the supervisor) to go around terrorizing people." Oh, and DURING the Administration Hrg. for one employee, the so-called judge (state-appointed Hrg. Officer) had lunch with one of the supervisors, then became offended when the employee's attorney brought the transgression up for the record. There are many other examples. But the bottom line is, the State Court System escapes accountability. The inherent conflicts-of-interest don't seem to matter; the waste of taxpayer money doesn't matter; the perjury doesn't matter; the undue influence; the illegal discrimination doesn't matter. But, worst of all, the TRUTH doesn't matter to OCA. Anybody with any suggestions on how best to expose this corruption is greatly appreciated. People working in a courthouse should not be allowed to commit the acts that are being committed, with no ramifications & accountability for their behavior, just because they have a title. As my supervisor said to me when he took over yrs. ago - - he folded his hands across his chest - - & he said, "I have power just like God; isn't it great?!" Pretty sick, but completely condoned. Not to mention the "F- - k you" sticker left on my desk! But up till now, they're still getting away with this. Thank you in advance. p.s. - - some media outlets seem to be kind of hesitant to expose this as well, which is really sad.
