Was the Constitution Democratic?

Is the U.S. constitution a democratic or anti-democratic document?

  • Im referring only to the U.S. constitution without the amendments. Please explain your opinion with evidence/support. Thanks!

  • Answer:

I agree with LiberalPHd. He gave my answer. The Constitution did not become the supreme law of the land just because the document itself says so. Those who framed it knew that it would not be accepted as law unless it had been ratified. It was ratified by ratifying conventions in the states which were chosen by "the people." True, only white, male, property-owners could vote. Would the outcome had been any different if non-property-owners and women had also been allowed to vote? It probably even would have been ratified if "slaves" had been allowed to vote, too. The Constitution does provide rules for what legislatures may and may not do. But the rules which were adopted were made democratically.

The Constitution is a document that establishes a "Republican form of government". Despite what schoolteachers and pop culture says, the United States does NOT have a democratic form of government, and we are NOT a democracy. (Do not be confused; Democracy and Republic has nothing to do with the Republican and Democrat parties; both parties are controlled and act in their own interests) A democracy is based on the principle of "mob rule". This means that 51% of the people win and the other 49% lose and have no rights. In a Republic, 100% of people are guaranteed all their God-given rights (enter, the US Constitution). [Please see "Constitution class for patriots" by Michael Badnarik on Google Video] However, in the past 100 years or so, we have been run as a democracy. With the passage of the 14th amendment, we are now living "outside" the Republic since we are now defined as "Citizens of The United States". This puts us under the control of the Federal territory of Washington D.C. [http://centre.telemanage.ca/links.nsf/articles/C33C98E582071B7F85256969004E3803%5D Hope this helps.

Both. While the constitution calls for liberty, see its preamble, "We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America," it is undemocratic when it orders us to pay taxes and here is the article or order, "Section 8. The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;" It is undemocratic because it doesn't consider people who don't want to pay taxes or who can't pay them.

Since I don't have a copy; the best I can remember it identifies the three branches of government and responsibilities. The amendments was the first step to a Democracy; The last in 1912 when election of senators was enacted.
