Its starting to, so yes. Despite arguments, look to the District Court in California. Recently heard a case about DADT and found it violated the 14th amendment. The President has and actively uses Veto Powers on laws he does not like and Congress has and continually tries/succeeds in overturning a veto with the required Majority. The Checks and Balances are alive an well, its only that the Judicial system is starting to remember their roll and hold the other two branches of govt accountable.
