What kind of a Visa I need to live and work in Germany for at least a year and what are the requirements?
-
I'm Australian citizen and my boyfriend is permanent resident in Australia however he's going to get his citizenship soon, he's got Austrian citizenship. I'm not sure if I can apply for anything like a spouse Visa through Austrian embassy or I have to apply for a working Visa through German embassy which I think requires me to have a job and a place I'm renting there already to do so. I also need to know if with a Visa I get I can travel all over Europe for that year.

Answer:
First Germany does not have any spouse visa even if you were married with your bf. You will need either a long stay visa ( Resident permit) if you do not intend to work, a student visa if you want to study at a German university or a work visa if you intend to work ( be aware this is a lot harder to get than a US Green card) Also be aware if you apply for a student or work visa you need to provide proof of sufficient skills speaking German. You need to apply for the visa at the German consulate not the Austrian one the so called Schengen visa is only a tourist visa ( NO WORK and NO studies possible with that ) If you get a visa which will allow you to work and be a legal resident that is valid for the entire Schengen zone ( UK is non member of that treaty to give an example; there is no visa for entire Europe there is the Schengen zone most EU / EEA countries but still a lot of countries in Europe are neither member of EU nor Schengen)

In order to live and work in Germany you do not need to apply for a visa from Australia but can apply for a residence permit after arrival in Germany. However in order to apply for a residence permit at the German authorities you would need to show that you have a work contract. To issue a work contract for a non-European Union (EU) citizen your prospective employer would need to get an authorization from the Labour Agency and would need to prove that s/he was not able to fill the gap with the local workforce and the workforce of the EU. Furthermore in Germany there were restrictions to the German labour market for the new EU countries during a transitional period of up to 7 years after accession of 10 Member States to the EU on 1 May 2004. Hence on 1 May 2011 citizen of Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia, and Slovenia will have unlimited access to the German labour market without the need to get a work permit. This will further minimize the chances for non-EU citizen. http://www.auswaertiges-amt.de/EN/EinreiseUndAufenthalt/Visabestimmungen_node.html#doc480844bodyText8 .. The easiest way to live and work in Germany for up to one year would be to apply for a Working Holiday Visa (which includes a Work Permit) from the German Embassy or Consulate General which covers your Australian state or territory of residence. It can be issued to Australians between 18 and 30 years. See detailed requirements here: http://www.canberra.diplo.de/contentblob/1672254/Daten/784831/download_datei_mb_woking_holiday_visa.pdf .. Your Working Holiday Visa and the temporary residence permit (which will be issued at the town-hall of the German community you plan to reside in) will also authorize you to travel to the other Schengen countries and stay for up to 90 days within a six months period without border checks at the Schengen area's internal borders. Your Australian passport also grants visa-free tourist travel to the other non-Schengen countries in Europe exept Belarus, Moldova, Russia, and the Ukraine. http://www.auswaertiges-amt.de/EN/EinreiseUndAufenthalt/Schengen_node.html#doc480998value2 . http://www.skyteam.com/about/travelhelp/travelinfo.html .. You cannot apply for any spouse visa at the Austrian Embassy if you plan to live and work in Germany.
