Traveling to the UK After A Ban; Commonwealth Passport?
-
When I was in my early 20's I wanted to make a new life in the UK. Ignorant of UK Immigration law, I made several mistakes and I was asked to return to my country of origin three times. The first time was the initial deportation after a visitor's visa ran out. The second time was when I returned to the UK believing that I only had to leave for a few months, and the third time occurred two years later while I was on holiday in France, in 1999. The first two removals occurred in 1997. As I understand it or was lead to believe, there is a 10 year ban on people who were removed from the UK, and this October will mark my 10 year anniversary. I am no longer interested in immigration to the UK. However, my partner wants to tour Europe in January 2010 and wants to visit London. I explained my situation to him and he believes that I may be granted entry as a tourist. Additionally I own a second passport from Guyana, a former British colony. I am a US Citizen with an American passport, my primary. My question is: will I be granted entry clearance to the UK since it has been 10 years after my last ban? Can I use my Guyanese passport to travel to the UK? Any advice is appreciated.

Answer:
Yes, there is a ban of 10 years if you have been deported at cost of the British Government; if you have voluntarily left the country the ban will be shorter. http://www.ukba.homeoffice.gov.uk/policyandlaw/immigrationlaw/immigrationrules/part9/ .. Contrary to the United States the U.K. Immigration Law does not have a lifetime-ban on visa-waived travel as there is no special visa waiver program in the United Kingdom; you either are a visa national who must apply for the visa in advance through a U.K. Border Agency Office associated with a U.K. Embassy/ High Commission/ Consulate General or you may apply for leave to remain on arrival at the United Kingdom. http://www.ukba.homeoffice.gov.uk/visitingtheuk/visitors/eligibility/ .. Your U.S. passport grants you the right to apply for leave to remain on arrival at the United Kingdom; a visa is not required. You would need to apply for a visa through the U.K. Embassy/Consulate if you would decide to enter the country using the passport issued by Guyana. http://www.ukvisas.gov.uk/en/ukvqr?redirect=true&promoId=1910262&reason=Visit&nationality=Guyana&location=United+States ..

Even if the ban has dropped off, you will forever have a black mark against you as far as the UK is concerned. You will need to officially apply for a visitors visa to the UK each and every time you wish to visit. (been there, done that) Belle

I would suggest you contact the nearest British Embassy to clarify the situation for you.

You probably have more chance of success if you use your US passport and are upfront and honest on your visa application about your previous mistakes. If your travel itinerary shows clearly your onward destination, you may be in luck. Do also be aware that when you apply for a Schengen information on your previous immigration history will be known to all EU countries. Any attempt to conceal your previous history will almost certainly be futile. If you were arrested and deported your fingerprints and photo are on file and you have to have a biometric appointment to get your visa.

Yes only on a tourism visa that only lasts 30 or 60 days. But the govenment dont care any more and basically just opened the borders to everybody so just come on in, who needs a passport...
