How do people get 'Indefinite Leave To Enter' for the UK?

  • I'm totally confused here. Spouses usually get the UK settlement visa for two years. Later they apply for Indefinite Leave To Remain... However, I also hear all sorts of things about 'indefinite leave to enter'. Can this be applied for? Or is it something that is issued by the decision makers when people apply for settlement but are already very close to satisfying the requirements for Indefinite Leave To Remain (For example, they have been married for several years / meet all other criteria except passing the Life In The UK test etc.) Finally, presumably even if granted indefinite leave to enter, I assume that the overall costs remain the same but just the journey to Indefinite Leave To Remain and beyond is shortened in time... Is this right?

If the non UK spouse has been living outside the UK with their British spouse (and married) for at least 4 yrs prior to applying for a settlement visa, then they need to apply for a settlement visa and request a KoL endorsement. There is not a section to do this, but should be included in the additional details and/or in the covering letter. The KoL endorsement will mean as soon as the spouse reaches the UK and passes the Life in the UK test (and English test depending on where you are coming from) then they can immediately convert to ILR. You want to obtain ILR as soon as possible, as UK immigration laws are changing and in July 2011 they are doing away with it. Those who have ILR prior to July 2011 will not loose their status and will be able to keep ILR and be under the 'old' rules. If you can afford a quick trip to the UK, the spouse can go ahead and take the Life in the UK test and then be granted ILR as soon as their application is approved. Donna
