Can I still Get US Visa???

  • I am married with US Citizen. My husband has applied I-130 Spouse Visa for me in USA and with I-797 receipt he filed K3 Visa for me in last few days. But our main problem is that he don't have any Job and can not work for like 3-4 more months and he don't have assets and his Income Tax return is below the poverty guideline. Now how can he fill affidavit of support for me for K3 or I-130 (Spouse Visa) or Can i get Visa without Affidavit of support Anyone Please guide us to solve this problem. We really love each other and want to live together. Please

    Technically, the K-3 visa does not REQUIRE an Affidavit of Support, though an I-134 is often requested. One way or another, the consular officer will need to be satisfied that you won't be a public charge. That could be based on your income or assets, or based on that of a sponsor. When you adjust status to CR6 (if you've been married less than 2 years) or IR6 (more than 2 years) in the U.S., I believe your spouse will need to submit an I-864 affidavit of support, even if he's below the poverty line. If he has insufficient income and assets, then a joint sponsor will also need to submit an I-864.

Shame you went for the near obsolete K-3 and not the cheaper CR1 But in all case the affidavit of support is the most important document ... Without a co sponsor he will not be able to get the visa May be better to wait until you can actually afford it

There is no way he can omit the affidavit of support unless one of his family member co-sign with him and if nobody signs with him than you will not be able to have your visa approved.
