What Questions will be asked in Divorce Court by Judge & Lawyer?

  • Hello, My Friend's Husband Filed for Divorce, they had small family differences, which went out of control and her husband asked her to leave, so her brother came and got her, they been living apart for almost 2 years, she is dependent on her brother, mentally broken, tried many times to get back with husband, called lot but he never answered and if he did answer, he refused to get back. He filed for Divorce now wanting all part of her finance, which she doesn't have, he married her in India, and brought her here, and she stayed with him and worked in family business. Now, her lawyer filed same asking for part of his property, she doesn't want it but lawyer insisted, although in court she will refuse to take anything from him, just want to get this over with. Her husband doesn't want to settle, just doing this to hurt her. I want to know what kind of questions will be asked in court / which way and if there is any site that has sample of this questions? Thank you.

    You can print this out and show it to your friend. Your whole life will be put on display. You need to be completely honest about everything the judge asks you. You will be asked where you work now, wage, work history, history of relationship with soon to be ex spouse - and you will at times feel pretty violated. They judge is there to mediate and make both sides come to an agreement and if they don't the judge acts in the capacity of an arbitrator/mediator and meets both sides in the middle. If this is a contested divorce like you say lots of things will be brought up - maybe the soon to be ex will accuse your friend of being an adultress and make up stories of her with other men. Nothing is out of the question as contested divorces that have spouses out to ruin the other spouse are horribly nasty, emotionally and physically draining. Use the financial affadavit she has to fill out before the hearing as a guide and make sure the numbers are honest as she may be questioned about her earnings/expenses.... There are no boiler plate questions because each divorce case is unique in its own right with different circumstances surrounding the couple wanting to get divorced. I am sorry for her situation.
