My husband has our daughter and is keeping her from me as punishment for leaving him. How can i get her back?

i just went trough that same thing except my husband and i were livin in the same house and he got mad because i filed for divorce because he got a woman pregnant on his job. so he hid all 4 kids for me for about a month and told the courts that i abondon our children and he didn't have a choice but the day he did it is the day she had the baby in fear of the divorce and losing everything he did that. So when i took him to court they granted him tempory custody until i got me a place because the house we lived in was under his name to make a long story short i had to go to my kids school and get letters showing i was not unfit and i was even lucky enough to get some of my kids teachers to go to court to testify without me even nowing now i'm living better than i ever have with a new man in my life he loves my children like they where his own and that ex is gettin the kids fri, sat and returning them on sun night court ordered don't do what i did cry so much it puts u in the hospital keep your health and head up email me anytime if you need more help or call me on the computer i can give you full details as to what happened everything will work itself out for the better of you .

Hi BawBabyDoll, I kinda agree with NYLOVE about something missing from this picture? In most states (I Believe)when couples are married and some cases living common law,and children are beared both parents have legal custody, but it doesn't give neirther parents to remove a child from the home. or least to say move the child to another town. Why didin't you call the police? He must have something on you for an out of town judge to grant him his request to obtain temp custody. A stay at home mom is not good enough grounds to grant your husband's wish.

I am sorry to hear about your situation. Your husband must prove you are an unfit mother, and that is not an easy thing to do. When you get prepared for court DO NOT sign off as "Primary Custodial Parent" as I am sure your lawyer has told is very important. Also, ask for more than you intend to get, i.e. ask for FULL custody. Can he prove you "abandoned" your daughter? Did you in fact leave your residence & not take your child with you? If so, that can be seen as "abandonment". Be ready to prove... 1. you have a job. 2. You have quality childcare (grandma, aunt, family is way better than daycare that has alot of other kids to attend to). This may have been the man you married, the father of your child, but when you are fighting for your child, you'd best be prepared to bring out your inner B*#ch, or you will get nowhere. Giving in, being nice, or being the bigger person will not get your daughter back to you. Also, this is extremely important! Keep a daily journal of EVERYTHING! When you get to see or not see your child. When you call. What response you get when you call or ask to see your daughter. Even minor details, dates, & times that may not seem important now, will become very important in a court of law where you must prove your case. It is not easy to remember details when you are in court in front of a judge, the daily journal will do that for you & keep you from stumbling or looking like an uninformed idiot! Hope it helps! sweetie take him to court because he has no right to keep her from you at all. it takes two to make a baby. not one unless he held the baby in his tummy for 9months

there is something really wrong with this that should have never happened he should of never been able to file no papers taking her from you just because you didnt want him in your life.and on top of that he took off with her without your knowledge.you need to charge him with kidnapping or something. i really feel for you i hope you get your daughter back,good luck to you and god bless

Go get yourself an attorney and file a suit for more privlages. The fact that your husband is trying to hurt you by using your daughter as a weapon won't look good in the courts eyes, judges tend to lean towards giving custody to parents who want to maintain a good realtionship with the other parent for the child. It may be a lot of money, however when it comes to my kids I find that the money ends up not mattering as much. Good Luck.

The judge can be hard to convince,so call some kind of shelter or hot line and tell them what your husband is doing.It sounds to me like your husband is stubourn.This situation should never occur to a women or man.Honey,all i can say is pray,pray,pray.Express your feelings to the good lord.He'll work it out.Your husband cant get away with something like that.Good luck my dear.
