How can I get full custody of my daughter?

  • Hi I am a recently divorsed mother of one and I have shared custody of her with her dad. Even though we have split custody, she never wants to go to her dad's house. We have to make her go on those days. But what really bothers me is the fact that whenever she comes home from his house, she is always crying. She tells me that she is crying because her dad always yells at her, he blames her for everything, he tells her that he doesnt even want custody of her when he is mad, he gets drunk a lot, and he says he is miserable because of her sometimes. I just hate too see her crying and being really sad because of him. She doesn't even want to go to his house. so is there anyway to get full custody of her? I didn't wanna go to that, but he is really hurting my daughter's feelings day after day. My daughter is 13 years old.

    There is no easy answer as you well know. Yes there is a way to get full custody. You will have to see a lawyer and prob. have to go to court. Your daughter is 13 so if it comes to that, the judge will likely consider her opinion in this. Sit down and talk with her, ask her what she wants. Tell her that you love her, that your relationship with her father has nothing at all to do with her. That your concern is for her. Honestly you deserve more than a few sentances of an answer. Absolutley...you must file for full custody and document all your daughter says...when you have a court date you show up and explain your reasons...they may want to have a professional ask to speak with your daughter........you must file for custody and bring up the drinking part....the court wont like that he drinks and verbally abuses her...you should call you ex and tell hime that your daughter doesnt want to come over anymore and that he should respect her wishes...if he argues the point then you must go through the courts asap

where i live children after 12 years old can decide whether they want to see the parent or not. maybe u go and inquire at your court house, she is old enough to decide what she wants. my children go visit their father when THEY want, not when the court tells them
