What age do we live in?

What is the age were you can choose what parent to live with if they are divorced?

  • im 16 and i live with my mom, i want change so i want to live with my dad but shesaid she'll see me in court cause shes not going to let me go, dont i have a right to say who i want to live with? do i have to go to court? i live in PA

    There is no magic legal age. Judges may consider any number of factors when determining whom a child will live with. Because you are 16, a judge would probably weigh your opinion quite heavily in making the decision. Ask your father to file for custody.

I think that you do have a right, just talk to your mom and convince her because going to court may shatter your family relations.

The judge will ask you where you want to live and he will check the living situation there, since you are 16 you wil probably need your own room. In ohio you have to be 12 or older for a judge to do this.

i live in FL so itt might be different but my dad is a divorce lawyer. He said that the kids opinion matters but it matters more who is suitable to be the 'lead' parent

If there is no way you can get legally emancipated You'll need to go to social services and have them help you out. They won't do it if they don't find a reason for you to have to be emancipated though, or if your plan is unrealistic. I think you should have the right to choose lol

im sorry to say but you have to go to court. the court decides who your legal guardian is.
