Help me, need to get my money back from ebay?

I bought a set of pans for 50GBP on ebay in may. I received the item and it was not what was described so agreed with the seller to return the item for a full refund. I sent the item off with proof of postage with the postcode written on the receipt. A few weeks passed and the seller said that he had not received the item yet, and would be on the lookout and that he would send the money soon. However 45days after the item was bought, I received a message stating that the seller would not return the amount back to me as the item had not arrived. I tried to open a case but the day limit had passed and therefore I couldn't even try and get my money back through ebay. I tried contacting him but he became ruder and more aggressive stating that he would not return my money and told me to open a case even though he fully knew that I couldn't any longer. I was not aware of the 45day policy as I am quite new to ebay and never had to open a case. I contacted ebay many times but they kept sending me messages that they were not able to do anything as the 45day was in their policy. This morning I called ebay customer service and the lady who answered was sympathetic but said that she could only offer 1 voucher of 25GBP as a courtesy. I asked to be transferred to her supervisor, who sniggered into the phone as if he found my situation amusing. He told me that I was breaking his integrity when I said that ebay could offer me 2 vouchers to make up for the 50GBP and I was cheating, laughing in my face and was an ***. He obviously could not be bothered to deal with my case. He told me that only 1 voucher could be issued to one account. Therefore I offered that one voucher could be sent to my account and the other to my daughter's account. This seemed like a reasonable solution where I could get my 50GBP back and no ebay policies would be broken. However he once again said that I was being a cheat and that I should stop using profanities, (which i wasn't) and that this was being recorded, threatening me. I feel utterly scammed by the seller who obviously had no intention of returning the money to me but made it so I couldn't even open a claim and ebay customer service is being rude and unhelpful. Is there any way to get my money back?

Answer:
ebay dosent have to pay you back for the item however if the item really never got to the seller then you can claim for it back via the post office or delivery service you used to send it! if thy can prove that the seller received the item and hasnt refunded you then you can report him for fraud and get him into trouble with the police !
