Am I eligible for Unemployment in New York?

New York State Unemployment, need some help!!!?

  • I am employed full time, but my current employer is in the process of being bought out by another company. It will take a while for the sale to go through, but there is a chance that I will be layed off at some point during the process. I've decided to get a part time job in addition to my full time job to help save more money in case I am let go. I've been researching NY Unemployment Laws and if I have a part time job working 5 days a week then I will not be eligible for unemployment even though the part time job would pay about 1/4 the amount I would get from unemployment (Which is less then half of what I would be making at my full time job). My question is if I quit my Part Time job the same day I was laid off at work, would I still be able to collect Unemployment benefits. I wouldn't want to use Unemployment if I could find a full time job, but at the same time I wouldn't want to be cut off from it if I really needed it. Please only answer if you have some knowledge or experience that is relevant. Thanks

    I think that you could possibly keep your part time job, but your benefits would be reduced by the number of days that you work, based on a four day work week. That might be worth it if you had a really great one day a week gig. To answer your question though, I think that that would not hurt your elogibility or benefit structure. I think you should consider that unemployment will only pay a maximum of $405 a week, so if you can make more then that at a part-time job then I would suggest you take the job. If you work part-time and work less than 4 days a week you can receive unemployment benefits for the days you do not work and that way if you decide to leave your part-time job you will already be in the system with unemployment and not have to worry about doing the process all over again.
