  • What are the legalities in selling a flat in Scotland. Buyer is now messing about - where do I stand when entry date is this week supposedly

    If entry date is this week then all missives etc must have been signed. Get your solicitor on to them. If no paper work has been signed a move in date could not have been agreed. Usually missives are signed up to 2 weeks after a price has been agreed. When signed the buyer cannot pull out without hugh financial cost to them.

If the entry date is this week, and you have all the paperwork signed, then as long as the funds have been transferred on the entry date, you can throw them out. If nothing has been signed, then get yer bum round to the solicitors and ask why nothing has been signed, cos you wont be moving in this week, I can assure you of that!

Once a price has been agreed, it is legally binding in Scotland, therefore no gazumping etc.

If missives have been siged then its legally binding. You can take them to court and get money plus they have to pay costs. Its a lot safer and fairer in Scotland when buying houses. Are you in Scotland too? If not and you have an English solicitor its prob time to give a Scottish solicitor a ring and get some advice..
