Can your neighbor's landscaping company cut your tree without permission?

Our neighbor has hedges lining her yard that go down along the side of our yard by our driveway. There is a tree in our yard about 2 feet away from her hedges that is still small and a coupld of the branches were a little close to her hedges. Is it ok for her landscaping company to come over in my yard and start cutting branches off of our tree and put a lot of knicks all over other branches without first asking us if it's ok? I confronted the landscaping guy about it and he said some of the branches were blocking the sun and he has to try to keep his client's hedges healthy. So, that gives him the right to go on someone else's property and cut on their stuff so he can keep his business?

I'd be PISSED.... The issue here is being a thoughtful neighbor. If the limbs of your tree are causing any issue in the neighbors yard, the polite and ethical thing to do is for them to come over and show you what their problem is and ask if it would be alright to cut the limb back to a certain point. Most of the time if someone approaches me politely and showing respect for ME as well, I'm happy to oblige. If I truly didn't agree with cutting the tree THAT far back then I can then voice my opinion and we would hopefully be able to come to a happy conclusion for all. It was not appropriate for the gardener to take it upon himself to cut more of your limb than was literally hanging over your neighbors side. Your neighbor may not even know that the gardener did this without your knowlege at all... Who knows? Bottom line here people is to be a thoughtful neighbor.... Thoughtful neighbors make enjoyable neighbors....

He does not have the right to come in to your yard. He has the right to trim any branches that are on HER side of the property line, but if he comes on your side of the property line he is trespassing. If it happens again, warn him that you will call the police. If he were to be injured on your property, he could sue you. You need to be sure you are protected.

In the UK you are allowed to cut branches off your neighbors tree that are comming into your property, I dont think theyre allowed to come into your garden though and theyre not allowed to cut it unless its in their garden Lol! Yes, go and trim their hedges!

if the tree is yours he had no right to do it. maybe you should go over and trim her hedges yourself and tell the neighbor the hedge was interfering with the growth of your grass

If the branches overhang the property line, he can trim them slightly, but only to the line. He has absolutely NO right, nor any reason to come on to your property. I suggest calling the better business bureau, and if it happens again you might have a claim for trespassing. You have to be very careful because if he hurts himself on your property you become liable since it's not your contract, blahblah...

I would think he had the right to only trim if the branches were hanging over in their yard. Otherwise, he had no right.

Can they trim up to the property line? Yes. Can they come onto your property without permission? No. Can they damage your tree? In the US, mostly no. The law is: Anything hanging over in their yard may be cut by them. They have no right to cut your tree back farther than the property line. As far as coming on your property to do this. If you property is posted "No Trespassing" then they can't. I think you need to talk to your neighbor.
