Is it legal for my neighbour to come into my garden to cut his trees?

Answer:
You might want to check out the Access to Neighbouring Land Act 1992, UK, in addition to any rights included in deeds etc, as many modern places include rights of access, as other things such as drains etc run between properties, in addition to plants and trees. Ultimately I believe the 'Access to Neighbouring Land Act 1992' would allow for your neighbour to be granted access to maintain his trees, though it's always advisable to reach agreement mutually. It would be somewhat inappropriate for a neighbour just to decide to pop round, without the common courtesy of discussion beforehand. Likewise, it is courteous to allow neighbours access, at times that are convenient to all of you, so that maintenance can be undertaken. The focus should be on reasonableness and convenience for both parties, in my opinion. I'd speak with the Citizens Advice Bureau or a solicitor in the UK, if you'd like further clarification. Hope this helps. Good luck! Rob

No, he needs your permission. You can cut any overhanging branches and put them on his property as they belong to him.

If i am correct he needs to ask your permission, but then if you were awkward and said no you would probably end up doing it.. If he tidys up after himself, if let him carry on, at least he is trying to keep the place neat.

If your neighbours tree has branches that are hanging over ur property u r well within your rights to lob them off but you must remember to put he offcuts back in his garden. He has no right to come on to your property unless u have given permission

technically no, its called trespassing and they need your permission. but if you tried to take it to court you probably wont get anywhere i don't think, unless they cause damage to your property, they might think you are just being unreasonable. to be honest, it would be much easier if you just let them in, even if you don't like them - it will save you a lot of hassle.

he needs your permission, but if he doesn`t cut them then that would mean you would need to to keep your side neat. just tell him to make sure he tidy`s up when he`s done

Only with your permission, otherwise he's trespassing. If you prefer to cut any overhanging branches/foliage your side you can return them to him for disposal.

No, they need your permission.

It all depends. If he wants to be a jerk he will. otherwise legally he cannot.
