I sprained and partly broke my whole upper body from riding a roller coaster.can i sew the park?

On August 14th 2007, it was 11am at Paramounts Great America, Santa Clara, California. I was in line for the Demon roller coaster. i sat in the front row with one of my moms friends. as the ride went on i rushed down the hill towards the loop. i went over the first loop, and my back, neck and upper body hurt so bad and my breathing wasn't there for me anymore. it just gave up. i screamed and yelled to my friend i cannot breathe. my upper body hurts like its broken. I went over the second loop, passing out into a pitch black darkness,couln't breathe or move. between the time i was unconsience and when i woke up when people were exiting the line, i had a small visual dream or flashback of myself on the roller coaster in pain. Anyway i got off the ride and my whole upper body (hips to bottom of neck) were extremely sprained and broken. at that time did have the right to sew the park? the bad thing was i didn't report it to the park. instead i went on the bumpiest coasters,drop zone and the most painfull rides. (STUPID). could i sew the park? does it count as a roller coaster accident? if not what kind of accident was it? is it too late to sew the park? from that point i had serius back problems. the sad thing was that i was only 12 yrs old.

Well you can sew all you want but I don't think it will do much good (unless they have some clothes that need mending). If you want to sue, you can try, but I don't think you will get very far. It has been well over a year and apparently it hasn't done any permanent damage. At this point there is no way to prove that you were hurt at all. I also have to say, I have ridden The Demon hundreds of times in my life (grew up 15 minutes from the Great America outside of Chicago, plus I still take my kids there every year and don't go to the park without getting on it) and it is one of the smoothest coasters out there. Plus is is sooooo old school and these days is considered a kiddie coaster. I don't think you will get too many people believing you got hurt on that ride. As for the person above me, it's liable, not reliable (reliable is when somebody can count on you for something). I know you are all serious but I had to laugh at this whole thing, you guys need to work on your english...

No, when you get on the ride, you are FULLY reliable to what happens to you, unless you had died, because the cart fell of the track or something crazy but not completely unheard of happened.....

If you were so injured, why did you not inform the employees to call 911? If something was broken did you go to the hospital and get medical care along with x-rays showing the broken bones? And since no one is correcting you, the word is SUE. If you're going to sew, that means you are going to sew a dress or a pair of pants like with a sewing machine. Sorry, but it this was serious, you would have asked and received emergency medical care right away, not wait years later and complain about it. You would have had proof that you were injured there at the park on the ride. My guess is it would be a complete waste of time and money for you to even pursue the matter. You have no proof that you were injured there now.

You have to be kidding me!! You willing got a ride that clearly has danger signs posted warning you not to ride if you have back,neck or heart problems. This would tell any normal person that there is a risk of injury if you ride this ride. You didn't report it? Why not? Then you went on more rides? Sure you can sue and most likely you will wind some amount of money. It makes me sick to see these people win such frivolous lawsuits. It is not the parks fault your back did not hold up to the ride.

There's no such thing as "breaking" your whole upper body. There's no such thing as "partly" breaking something either. If you really did that, you would be in the ER. So you'll excuse me if I don't believe you.

Yes, you can sue the park and No, its not to late. Though i think you would be able to sue them for emotional distress and any charges for a medical bill that had to do with the accident.
