Will having a Class C Misdemeanor Disorderly Conduct charge keep me from getting a teaching job ?

A female that was my ex girlfriend came to my house and started beating on my front door. I live in a guard gated community. She first lied to the officer at the front gate and then came to my house where she began kicking and hitting my front door telling me to open the door that was locked. I went to the front door and told her to get off my property or that I was calling the police and so she left. I was working for a school district during this time. We had a football playoff game on the following Friday night that I was coaching. After the game I was entering the gates into my subdivision. The guard stopped me and said “The sheriff has been in here twice going to your house. So the next morning I called the Sheriff’s office. The lady at the sheriff’s office told me that I had a warrant issued for my arrest for threatening. I told her that I had not threatened anyone and asked who made this accusation against me. She would not tell me and said for me to come down to the Sheriff’s station. So I was arrested for accusations of threatening a person on my property, at my house, which was not true at all. So I went to my principal at the high school the next day and told him what had happened. I was placed on a paid leave of absence the next day. During this time the school district allowed me to work off the high school campus while things were being investigated. I had to hire an attorney to represent me for this accusation. It was presented to me if the charges were no dismissed by the first of January, 2010 that I would be terminated from my job. So I was presented with two options. I could either plead not guilty and continue going to court to fight the false accusations made against me or take a plea of Disorderly Conduct Class C misdemeanor and have my job back. Although I did not want to take a disorderly conduct plea, I had no choice because if I would have continued to go to court I would have been terminated from my job. So I was reinstated to my original status on January 3rd, 2010 at my school. So you see I was put in a bad position and did not have a choice. It was either plea to the disorderly conduct or lose my job. I was granted a lifetime restraining order against the woman from the judge yet I got convicted of something that I did not do.

In my state, a conviction of a felony is basis for losing a teaching license, not a misdemeanor. It does not sound as if your lawyer did much for you, sorry to say. You were smart to go straight to the principal and tell all. The only good seems to be the lifelong restraining order against the former girl friend. Of course, you were reinstated, but with an undeserved black mark. This is a sorry mess. I feel bad that it happened to you.

No, having a criminal history doesn't bar you from getting a teaching position. The only reason that you will not get hired as an educator is if you've been convicted of something that had something to do with hurting a child. eg: rapist, pedafile, taking pictures of nude children etc. The person that told you that you couldn't get hired obviously doesn't have a record and has no knowledge of it. There are plenty of people who have taught and retired from the school district that have criminal pasts but once they were hired they straightened up their act. While completing your degree make sure that you don't do anything else that will cause your record to increase. Make sure that you get really good grades and become the best teacher ever. Where I live (Ontario, Canada) having any official criminal record will prevent you from getting a teaching position. You might get a degree but you won't get hired.

Where was you solicitor/lawyer? In the UK we have a criminal records check. This covers any offence around child protection laws and any other serious offences. In my opinion a class c misdemeanour would not go against you. However, this would depend on where you are in the world. In the UK, it would also, be left to the person who was responsible for sending in , the criminal records application. They have the final decision. Good luck!
