What options do you have if you are refused help under the Americans with disabilities act?

By law, I qualify under the americans with disabilities act. I asked the faculty member who is on staff in the math lab to help people with learning disabilities for help, I asked if she could explain a type of problem to me. Her response was "you just want me to give you the answers" and not when you wait till the last minute. I didn't wait until the last minute I was working on the last skills test over a week before they all had to be done. I had asked for help with math in the accessibilities office before that and the same lady refused to help me. What options do I have, or do I have any options I don't want the lady to lose her job I just don't want anyone else that needs extra help refused it by her like I was. Its a good thing I found an instructor that helped me so well other wise i would have been out of luck.

Did you have an IEP in high school? I'm assuming you are in college now...if you have documentation that you have a disability you should be able to find an office in academic affairs to help you. Academic affairs should be able to assist you in finding out what type of help you are entitled to. You are probably elligible for support services like note taking, tutoring, extended time on tests, etc. Unfortunately, some people are just ignorant to the types of help people need. I have a physical disabilty but do not have outward signs that I am disabled....so people tend to respond so negatively to me when I indicate that I need help. I look healthy so therefore I must be lazy. I'm thinking this person might be interpreting your problems the same way. Don't give up! Track down the information within your school. There might be aides who are hired to help you specifically with these types of things. They are trained in how to help people with learning disabilities and won't give you a hard time about needing support. You didn't say whether you are in high school or college. If you are in high school, get a parent or an adult you trust to go to the principal about the problem. If you are in college you need to follow these steps: 1) Document everything that has happened in relation to this situation (include dates and times if you have them)- be specific as possible 2) Along with your documentation submit an Official Request (and sign it in front of a notary public) for assistance in that area 3) Contact the Dean of Students for a meeting regarding this problem. (Remember to document what the Dean tells you too.) I wish you all the best in getting this resolved!

If you don't want her to get into trouble you have no options. Otherwise write a letter to the state and complain.

Not helping you is not an ADA violation. Don't worry, her job is safe. The most you could do is complain to her supervisor, which will probably go nowhere. It would be an ADA violation if the University had a policy that specifically disadvantaged you. The ADA was not passed to make sure that you got answers to your homework.

The ADA does not deal with instruction modifications, but access issues. IDEA is the law that insures least restrictive and free public access to education. And there is no federal law that mandates instructional modifications for colleges, since there is no law that states higher education is required for all individuals. If you had an IEP in high school and are now in college, you need to talk with someone in the guidance office about support or special classes.

you must have an iep. do you have one? if you had one in high school, they should have tested you again once you started college. if you are attending a public college or university (a state university for instance), they must comply with the same laws that a public school has to. get in touch with the special services at your school and start there. you can complain until doomsday about university professors and personnel and no one would care. unless of course you insult someone like cindy sheehan or ward churchill and then all hell will break loose and the full weight of the libs will come down hard on you. good luck. get to student services.

In Kansas City, MO we have an organization called "Vocational Rehabilitation" that will pay for State Colleges in Full for an education to help you advance in your livelyhood, Private Schools ONLY a % can be paid!
