    That is true, you are legally dependent to your biological parents.. However, since you have been living with your ex stepfather for over one year, you should be able to go to your college's Financial Aid Office and fill out a form declaring that you are dependent on your ex stepfather for support. The Financial Aid Office will ask you if your ex stepfather reported you as a dependent on his taxes, which he should have if you have been living with him for over a year. If he has not claimed you as a dependent on his 2007 taxes then you might have to wait until Fall 2009 to be "officially" dependent on him if he claims you on his 2008 taxes. Good luck! :-)

I think for FAFSA you can be considered a dependent to anyone who would be considered to help pay for tuition.

Not unless he has been appointed your legal guardian by the courts. You need to use your real parents income.
