How to discharge debt?

Will Chapter 7 discharge this type of debt?

  • I was in school and received financial aid and then withdrew and was told I had to return my financail aid. I did not return my financail aid, but my school returned the money back to the government so that now I owe the school and not the government. The will not release my transcripts because I owe them money. I would like to know if I file chapter 7, will the debt be discharged and so they will have to release my transcript since I would no longer owe them anything?

    Your debt will not be erased if you file Chapter 7. Educational expenses will not be discharged. See if you can get on a payment plan at your school. That way, you won't be sent to a collection agency any time soon, and you'll slowly decrease your balance. Once you pay it off, you can then order your transcript. Sometimes schools will release transcripts to students with balances if the transcripts are for work purposes. The school will generally have to send the transcript directly to your work for you though. Just a thought if that's what you need it for, but if you're trying to get into another school, there is no way they'll release that transcript.

I would call a bankruptcy lawyer but I don't think that you can. All student debts are not included in ch. 7 or 13

No. Filing bankruptcy will not discharge a federal student loan. In fact, student loans are one of the only things that CAN'T be discharged by filing bankruptcy, regardless of the chapter that you file. What you should do is call Direct Loans, and ask them if you can set up a payment plan. This will refresh your account with them, and you should be able to obtain your transcripts. Hope this helped!

I don't think this is possible, but I could be wrong. Also, you might want to double check, because it's entirely possible you now owe money to BOTH. The school for not paying your bill because your financial aid was returned AND the federal government because you didn't return your financial aid.
