Can I sue my pizza delivery driver for calling my cell and hitting on me?

I am 8 1/2 months pregnant and really wanted pizza so I called and ordered a pizza for delivery from a huge pizza chain. The employee taking my order took my phone number, which is routine. The pizza arrived and I signed the credit card receipt. 10 minutes later when I happen to be on the phone with my husband who was out of town I received a text message that said hi im the guy who just delivered your pizza and i think you are absolutly beatiful im sorry i hope i dont sound creepy???? This might sound crazy but I feel so violated and freaked out that this man now knows where i live and my phone number. not only that my husband called the gm and complained, now im afraid that he got fired and wants revenge. Im really afraid now. there are crazy ppl out there these days. Not to mention my husband is LIVID!!! Can i sue the company for this?

Sue the company cause the guy sent you one text message? Not bloodly likely. It is not the company's fault. If you were to take legal action against anyone it would be the delivery guy directly, not the company. Yes it is creepy and wierd and yes your husband was totally right to call and complain but a lawsuit? No. If you hear from him again call the cops.

You should also call the police to report the phone call. That is considered a harassing phone call and is against the law.If this guy knows the police know about him he will be much less likely to contact you again.

First of all, congrats on the baby. You can't sue the company because if he is fired, you can't sue the company, but you can sue him or get a restraining order. If I were you, I would call your phone company and ask them if you can block him from calling you.

You may be able to sue the company for misusing customer data (phone number) I think there is nothing you can do legally to him, since he only expressed his thoughts. Should have just ignored the SMS.

It's the guy who's threatening you that you can press charges against him but not the pizza place.Even if the guy got fired the pizza place could tell him he is responsible for his own actions.
