How to list items for sale?

Do the items you list on your seller's disclosure become part of the sale of your home?

  • Hi everyone. Hubby and I are interested in a home in Minnesota. They didn't list their washer & dryer unit in the actual listing. However, it is included in their Seller's Property Disclosure statement. Does this mean they're required to include it in the sale by law?

    No. The disclosure should only tell the condition, If not in the listing, the Buyer would have to list it in their Offer to Purchase. Today most Sellers will want to include them, because they are difficult to move. Make sure your Realtor includes the words (at no value), since, the depreciated age should not impact the amount you want to purchase the home for. If they won't include it, then drop the price of the house even more. Trust me: its truly a Buyer's market.

That depends on which disclosure. In California it is called the transfer disclosure statement and if the seller list items on this form they are included in the sale. I would add it to the purchase contract just to be sure, when you submit your offer.

Since it's not listed in the listing, I would say no. The disclosure is a blanket doc that covers everything. The BEST and only way to make sure there are no problems is to add the W/D in the contract.

"Property Disclosure" has no legal meaning, and none of us can read the wording of your docuent from where we are sitting. The bottom line is this: You do NOT get the washer and dryer unless the contract or an addendum stipulates that you get the washer and dryer. Note that you can ALWAYS negotiate a provision stating that you get the washer and dryer. This is actually a good way to compromise on a sale price. For instance, you offer $95,000. Seller counters with $100,000. You can counter that with $100,000 with the stipulation that the washer and dryer stay in the home.
