Can landlord legally kick us out in 2 days my husband has become disabled?

My husband has a chemical lung damage workmans comp case going and we are only receiving $287.00 a week from unemployment our rent is $1000.00 a month, we have been late in the past and paid the balance as soon as we were able. Our landlord knows how sick my husband is and knows what is going on. We got a letter saying we had to go to court, when we got there the judge said he was a friend of the landlords wife so if we could not come to an agreement he would have to get another judge to decide at a different date. Our landlord basically said he wants us out in 2 days, wants all our furniture, my older car and that we were not getting back our deposit. He wanted us out so bad I actually just wanted to leave . My husband asked if we could stay 4 more days until my kids are off of school for the summer, he said you can go pick up the records at anytime, like my kids and their last days of school weren't important. I told them saturday we would probably get a check and we can not leave without any money. He said he wants the keys on the table Friday night by 6:00 pm My husbands attorney said make the landlord sue you so that will buy you time to stay, and even our attorney will talk to the landlord and reassure him he will get the back rent which will be 4 months late. There is no way I can take my boys 11,12,13 to a fricken hotel that cost $100.00 a night. The landlord is so evil he doesn't care about anything but his money. I do not want to stay here but without any money what can I do? since my husband has become disabled does our landlord have the legal right to kick us out in 2 days?

Yes, that is about how long the judge will give you. It is immoral and unethical of you to expect to be supported by your landlord. Him not wanting to support you is not evil at all. The odds are he can't afford to support you, you are costing him 1000 a month, most people can not afford that additional expense. He should have handled this months ago. You leached long enough.

You can't pay your rent and call the landlord evil. Why should the landlord help support you, who pays the bills such as property taxes, insurance and mortgage. Start packing and move in with family since 5 people cannot live on 1000 a month

Your attorney should be able to answer your questions much better than "we" can. Based on the information you've provided, you've already been to court - the landlord cannot take any legal action against you until the court decides the case. Regardless of what your landlord wants, you should be legally able to remain until a decision is rendered by the court. So you should have at least until your next court date, and possibly longer depending on the decision of the judge. If the landlord physically tries to remove you or your belongings on Friday, call the cops.

Your husband's disability does not allow yout o not pay the LL. He will have to go to court to legally evict you, which will take a few eeks at most. One way or the other, if you haven't paid in full pretty soon, you're out. Did you ever stop to think that the LL also has bills to pay and perhaps he relies on the income from yoru rental to pay them? He is not obligated to carry yoru financial burden for you.

I'm sorry your husband is disabled and that you have money problems, but that doesn't entitle you to live rent-free at the landlord's expense. Sounds like he went to court and got a legal eviction judgment.

There are some very unfortunate things that happen to good people. Unfortunately, your financial blight is not your landlords concern. You are 4 months behind in your rent with a promise that you would pay. What happens if your plan does not work out? Then you would be even further behind in your rent. The landlord has debts that he is obligated to pay each month. He depends on the rent he would get from you to pay these debts. You are currently using every excuse to remain there, "My kids are still in school" "Your attorney will speak to the landlord." Your attorney has indicated he suggest you remain there and have the landlord sue you, therefore you would be able to remain in the rental unit longer. Since you are 4 months behind in paying your rent it appears as if the landlord has made several concessions with you about your rent. I don't know about the eviction process in your state, however, normally after 30 days the landlord would be able to make a good case for starting an eviction procedure. You have been there for 4 months, without paying rent. How are you able to obtain the services of an attorney, yet is unable to pay your rent? I am not sure about who is evil here. When your husband first became disabled you would have legally been able to be released from your obligation. At that point you could have looked for something more appropriate. This isn't your home, and you're not fighting with a bank for the right to keep it. As others have pointed out, the landlord can't support you, he has taxes and insurance, etc. to pay. If you don't settle now and it goes to court, it will cost you more than you currently owe, and you will still need a new place to live. But, it will buy you more time.

Why isnt your husband getting SSI insead of unemployment for his disability? If you cant pay the rent, you get evicted. Go back to court and let another judge decide. You must have realized he could evict you when you didnt pay the rent. Would landlord take installment payments? Your rent is very high for your income. Why dont you have a job? If you consulted an attorney go according to his advice. You can move into a room for rent.
