Do i still have roaches?

Can i break my lease? Florida, roaches....?

  • I just signed a lease on an apartment 2 weeks ago in southern Florida and have discovered a roach problem since day one. Maintenance has been making efforts to rid the problem, including "professsional" extermination by an outside contractor, bombing, fogging, checking and re-checking for holes, cracks, etc, but the roaches are still showing up alive and well and several at a time. Although efforts are being made, the whole thing disgusts me and I cannot live there if the roaches keep coming around. What are my rights? Can i break the lease without incurring any of the costs associated with breaking a lease since the residence is just not habitable with roaches running around and the constant fumes of all the chemicals they are spraying.....(extra details: problem appeared to be in the kitchen only, but have found roaches in hall closet and in living room. roaches are various shapes and sizes including baby roaches!!!)

  • Answer:

No you cannot break your lease without recourse. Your landlord has been addressing the problem. Roaches are nearly impossible to get rid of so it's going to be an ongoing battle. You are going to have to do your part by keeping your kitchen free of any crumbs of food and to wash your dishes immediately after eating. Also, put borax down along the baseboards and inside the elec receps.
