Can I break my lease due to mold?

  • I am in an apartment with mold. I have 6 months left on my lease and I need out. On the first of the month i told my management that there was mold and they said they would take a look at it. I told them t wait until i was there due to privacy issues. i got a call when i was at work and told them to call me two days later on my day off (this was the first week of the month) and i have recieved no call or no attempt to solve/look at my problem. I have asthma and i have been feeling sick to my stomach and have been getting severe hives and allergy symptoms. I stayed away from my apartment for a few days and felt fine; no hives or other symptoms. Would i legally be able to break my lease? I feel like i am living in a health hazard

    No, you cannot break your lease over this mold, unless the molds happen to be one of the very few strains which are considered harmful to human. If you are allergic to mildew, as example, that's not the apartment's fault. And for heaven's sake, why didn't you let them into the apartment to look at this mold ? There is no reason you had t be there for them to look. Now you're complaining because they have not yet looked at the mold.

I think it depends on the state you should try calling the housing authority or the health department one of them should be able to help or point you in the right direction but I do know some mold is toxic and can kill if anything find an expert that will inspect it for a low cost that way if it is dangerous and you evacuate the premise it can make it hard for them to legally come after you

I had the same problem once, and was it a hassle!! It took them 3 months after I screamed at them for them to take a look. First thing do NOT stop paying rent cause it will bite you in the butt. You legally cant just stop paying them. It will take lawyers and alot of time and hassle to break the lease. What I did was threaten a lawyer if they didnt move me into a different unit. They ended up moving me and they had to pay movers to load up all of my things and move them to a different unit (I still had to pack them in boxes). I think I also got a month of free rent. Be very firm with them and even have your parents or someone else with you when you go to the office to complain. Good luck, I hope you get out of there.

If a landlord breaks his end of the agreement, you legally can break yours. 3. Have the health department look at the mold in your apartment. Call the health department in your county and tell a representative about the mold in your apartment. Tell her how long the mold has been there and when you notified your landlord about the problem. Documenting the issue with a phone call to the health department helps your cause. Getting someone to come out and look at the matter can help even more. When the health department representative views your mold in person, have the inspector write a report that says your apartment is uninhabitable due to the mold. 4. Write a letter to your apartment manager, indicating that you are breaking your lease due to mold. Place today's date at the top of the letter along with your name, address, and phone number, and the name, title, and address of your apartment manager. The first line of your letter should indicate who you are, where you live, and how long you have lived in the apartment. The second sentence should state that you are writing the letter to inform the complex of the date that you will be moving out of the apartment. 5. Deliver your letter to your apartment management representative. Hand the letter directly to the manager, if possible. If not, make sure it gets into the hands of someone who works for the apartment management.
