Who Got Busted In Mobile County In The Last 24 Hours?

I gave my roommate 24 hours last night to move out and she hasn't got all of her stuff yet.?

    What the hell? NO! You can't do that. If you own the place you have to legally evict her and obtain a court order. If you do not own the place the landlord has to do that. The police will arrest YOU if you try to pull this BS. You can not kick her out. You can not touch her stuff. She does not have to sign a lease to have legal rights, which you seem to have no regard for. If she is a roommate her rights equal your rights, and that is her place, she has the right to live there until a judge says otherwise.

This is what happens when you decide to 'take a roommate' without following proper procedure. The police will NOT become involved in this situation. Moreover, YOUR landlord might make life difficult for you for allowing an unauthorized tenant to move in with you. You have the right to call the police, but the police aren't going to do anything. Your roommate is a legal tenant, which means she has the right to stay until evicted by the landlord. This can take 30-60 days and if you touch her things or try a constructive eviction before then (changing the locks, turning off her power), then she can sue you. If you move her things out of the property, she can have you arrested for theft and various other issues.

If her legal address is at your house (it says it on her drivers license) I think you have to legally evict her before you can just throw her stuff out.

legally, she doesn't live there. If she doesn't pay and isn't on the lease, she is a trespasser as soon as you say she is no longer invited to stay. Tell her she has 24 hours to remove her things or you will bag them and put them out in the trash. You have that right as long as you give her warning and she gets the warning.
