In New York City, is it legal for one owner of a house to rent it out when the other owner says no?

  • The other half owner of a house my family owns rented out the house and is collecting rent when we are totally against it. Did the other half, pretending to be sole owner and rented the house did anything legally wrong? What can be done?

    No this is not legal. Since the lease is void I'm not sure if you need to evict the tenant or if you can just tell him to leave immediately or you are calling the police (explain it to him, but tell him he is there illegally and has to leave now - if you don't have to evict him). He could and should sue your co-owner for damages but that's not your problem. You may have to likewise sue your co-owner for damages (loss of use, repairs - if there are any). Anyhow, this is more detail than anyone on this board can likely give you, I'd call a lawyer. If you don't want to call a lawyer check the blue pages of the phone book and there will be some county/ city agency handling landlord/ tenant complaints. Try to call them and they should know what your next step is.
