What to do about termites in an apartment?

I have recently found termite dust and termite tunneling in my apartment. Dry wood termites.?

  • I have a 4 month old daughter. I don't want them spraying chemicals in here. What are my options when it comes to the lease? Can I demand they put me in a different apartment? What kind of hazard could this be posing to other tenants, myself and my family? Do I have a right to break the lease? It is a big apartment complex. About 25 apts or so.

You can break your lease if it is mutual between you and the landlord, if you have sufficient reason to believe that you are in danger from what is in your apartment i.e, chemicals, flooding, gas leaks, etc.

Check your local law, as in some states the landlord must act within a reasonable time. In most others it is just a matter of the apartments being kept fit for use, which gives the landlord a lot of room to squirm. So, bottom line for you is whether the apartment is structurally safe. Other than that, it is just the inconveniece. Your daughter can probably cawl around on the termite pellets without any serious risk to health.
