How to REMOVE THIS TENANT from the apartment building??

  • I own a 10 room apartment complex in the city. The apartment building has been given to the local housing. The local housing allocates tenants in the building. One tenant in the building has been a problem. Whenever we approach her for rent, she says "Oh. u can go f**** yourself." The tenant and her daughter continually tell us to f*** off and give us the finger. A notice to leave by the tenant was given on may 24. She verbally agreed to leave. The tenant later changed her mind on the notice to leave on may 31st. Basically, she wanted to stay. Another Tenant was allocated in her apartment by housing on July 15th. Since, it was assumpted from her prior notice that she was leaving. A court hearing was issued. Before the hearing, we walked by the tenant and the daughter. They were sitting down and said: "I saw u shake your head. Show some respect for my mother. You're in a court of law" I said "well, u don't know the meaning of respect." The hearing began. The judge agreed that the tenant should not be changing her mind regarding the notice to leave. Initially, the judge was in our favour. ie. Landlord. We told the judge that since the tenant submitted a notice to leave, another tenant was allocated to move on July 15th. The judge agreed. However, she started crying. I feel that in court she was acting. She said, “I’m homeless and I have nowhere else to go.” and submitted a document about her disability. The judge agreed about the tenant, and said that her disability was relevant for the human rights code. As a result, the tenant was granted to stay. Therefore, we were unable to remover her from the premises. We feel disappointed because this tenant and her daughter continually harasses us on the premises of the apartment. But we can’t prove that they’re verbally harassing us. How to remove this tenant from the apartment building??

you have to start eviction proceedings and have a constable remove her from the premises. She didn't provide disability forms to you personally and you should have told this judge. How old is her daughter? Is she old enough to be paying the rent? Non-payment of rent is a good indicator that she needs to be evicted.
