How wrong can a payee's name be on a check and still allow them to deposit the check or cash it?

  • I'm sure it's common knowledge that if the payee's name is misspelled on a check, they simply endorse the check using the misspelled name and then they endorse it with their correctly spelled name below that. However, my question is: How poorly can the name be spelled and still allow for the check to be deposited or cashed by the payee? For example, if the payee's real name (as on their driver's license) is "John Francis Smith," and their name on the account where they would deposit the check is listed as "John F. Smith," could the payee be spelled any of the following ways and still have the check be completely acceptable for deposit at the payee's bank (or cashing at the bank of the person who wrote the check)? John F. Smithe Jon F. Smith Jon R. Smith Jon R. Smithe Jon Frank Smithe Jonathan Frank Smithe Jon. F. Smith, Sr. Josh F. Smith Johnny F. Smith And if any of these spellings would still allow for the proper endorsement and deposit/cashing of the check, are there any spelling examples that would just barely fall short of the requirements?

    Variations are allowed as long as the bank believes the person submitting the check is actually the person it was written to. In the case you describe, the 'proper' procedure would be to endorse the check AS WRITTEN, then endorse below with your correct name. I see 4 names on your list that may be a problem. Stictly up to the payee's banks policy. They may deposit it, with the understanding that if it gets returned by the Payor's bank, they will take the funds from the payee's account. The payee's bank may refuse to cash the check and tell the payee to get it fixed. The bank may call the payor to verify the check is for this payee.

Always deposit checks. Never cash them. You would be surprised what a bank allows. Deposit it.

It really depends on the bank and your relationship with them. Is this YOUR check we are speaking of? Someone made it out to you incorrectly? I would say contact the issuer to see if it can be corrected immediately - If a different check can be written. Or contact your bank, talk to a teller or the local bank branch manager. Let them know who you are, how long you've had your account with them and tell them ' before i drive down there to deposit it, I'm concerned with how my name was written on it' See what they say? They may give a manager approval based on your account history. I was a teller for several years, and people who had been with the bank many years, had a good history, sufficient balance, etc were made exceptions. another factor in this may be if you are depositing or cashing. A misspelled check might not be ok to swap right to cash but they may allow it to go through processing for deposit and next day withdrawl.
