What can I do if a bank is asking me to pay for an $8,000 loan that I never received a penney of?
-
A "friend" I knew worked at a local bank. He asked me to sign up for a checking account. I agreed to sign up for it. I signed the paperwork that he told me to sign. Six months later, the bank is calling me asking me to pay on the loan. Turned out my "friend" was fired from the bank for tampering with bank accounts. I never received a debit card they claim they mailed or a pin. This was obviously identity theft. The only thing I did receive was blank checks, which are still sealed. The bank said they were aware that there was some forging going on in my account. They say that I'm not liable for 2 checks written since there were different date of births and socials on each of them. They said they know I didnt make out those 2 checks. They are still holding me accountable for the loan which doesn't make sense to me. Is there anything that I could do to fight this? I cannot afford to pay this and cannot have this on my credit history

First, talk to a different manager - demand a copy of the loan docs and then you need to demand a form so that you can document your claim of fraud.......Don't ignore this, because it will damage your credit.....Next file a police report for fraud/forgery/identify theft and ... Then you need to formally dispute it w/ the bank....send letters to everyone in the food chain.....and ask for the fraud department....most major banks have an internal fraud department to investigate their own employees suspected of theft.... Do all that before getting an attorney....it will be time consuming and frustrating, but don't give up...... In the mean time, document what has transpired thus far....dates/people/conversation......if the bank claims they new there was suspicious activity on your account and neglected to pursue it, hmmmm.....that gives your claim more validity.. Be professional and document everything.

you should not pay any of it. Maybe they got the wrong person.

Contact the police department and file charges. Also you can prove that it was never sent to your address. You can also show that you did not sign the checks. the bank will have to have a record of who signed for the money.

Did you bother to read the fine print in the agreement you signed when you "signed up for a checking account"?

The lawyer and local police probably have an ongoing investigation. They can add this fraud to your "friend's" list of charges.
