A mistake is made in the amount of a check (number amounts differ) can it be cashed? What amount governs?
-
The numbers written on the check are $1,240.90 The spelled out amount is Twelve hundred and forty. Can the check be cashed and for what amount?
-
Answer:
According to the UCC (Uniform Commercial Code) Article 3 - NEGOTIABLE INSTRUMENTS -paragraph 3-114L: Contradictory Terms of Instrument: If an instrument contains contradictory terms, typewritten terms prevail over printed terms, handwritten terms prevail over both, and words prevail over numbers. This is the law. The bank would go by the handwritten words over the printed numbers.

It will be cashed for the amount that is spelled out

Most places will not,you will have to take the check back to who gave it to you and have another one made.not even banks will.

My bank goes by the written amount of the check. You may want to contact your bank and find out their policy.
Q.S.G
When there are discrepencies on a check between the written amount and the enumerated amount in the box, the written amount prevails. Good tellers are supposed to check BOTH the written amount and the amount in the box for agreement. However, in their hurry to service customers or in their sheer laziness, this does not always happen. However, to argue over $0.90 would be a bit counterproductive. You would spend more time in red tape than the amount of the discrepancy is worth. Good luck.

It will be cashed for $1240.90, the numerical amount.

Somebody might accidently cash it, but it will come back and bite everybody in the butt. You have to get it corrected first.

That is a good question, i think the numbers are the more important.

Depends on the bank. I deposited a check that the amounts differed and my bank returned it to me. I had to have the person write another check. If they do cash it, it will probably be for the numerical amount.
