Father took $45,000 of my $50,000 settlement from joint bank account...?
-
When I was very small, I was in a car accident that, according to the paramedics, was supposed to instantly take my life but put me in a coma for a few months instead. Anyways, I get a $50,000 settlement every four years until I have obtained $200,000 and my father has just recently taken the vast majority of the first settlement fraction ($45k/$50k) and put it in his own private account so I couldn't access it. Now, I'm 19, I have a baby on the way and I'm struggling financially and all I need is just a few hundered bucks to get by but my father won't give up my money. I understood, long ago, that he was just being a parent by "monitoring" my spending, though it's still bullshit, but now it's getting old and I'm starting to wonder of he has tapped into it because he has randomly brought a 1000 dollar TV like it was nothing not long after he ripped me off... Please help me. I have asked this question before in much less detail and people have told me to go to the police but the police just told me that it's my fault for trusting my dad to open my account (I didn't know better) and that I need toget an attorney and get my finances in order. I do not want to get an attorney. I need to know what my rights are being on the account and it being my settlement, and I need to do to hold up in court if need be. Is there any way to have the bank just handle it? Do I even need an attorney? Would a bank statement do?

Answer:
you DO need an attorney. You had both names (yours and Dad's) on account. He is within his legal rights to take the money. morally he is WRONG and is making a big rift in your relationship

You wrote: "...I do not want to get an attorney..." Well, if you do not want to get an attorney, you can hope that your father returns your money to you, or you can just forget about it. You asked: "...I need to know what my rights are being on the account and it being my settlement, and I need to do to hold up in court if need be..." That would be one of the things you'd want an attorney to answer. You asked: "...Is there any way to have the bank just handle it?..." You could probably ask the bank to "just handle it", but since your father owns the money just like you do (you and he are the joint owners of the money since you are the joint owners of the bank account), the bank will say no. You asked: "...Do I even need an attorney?..." You already know he answer to that. You asked: "...Would a bank statement do?..." All a bank statement would do is show that you and your father own a bank account and that you each have the right to spend the money any way you want to. Look: your options are limited. The settlement probably has terms on it that allow you to get the money when you turn 21 or 25 or something. You need to see the settlement terms agreement and determine what your rights are. I'm going to recommend that you do that with someone who knows the law.

Sorry but you do need an attorney - you may have to sue for the return of your settlement.
