Bank Of America Chargeback issue?

OK so I go to bank of america to deposit my check. I asked her can you give me $44 and deposit the rest, the banker said "sorry it says no cash available" so i was like ok deposit it all then. She deposits my check then I was about to leave and she was like ohh wait let me see the reciept, then she tells me that her computer shows she can give it to me so she gives me $44. The next day the bank does a chargeback and places all my money on hold for 5 days, I had 3 transactions coming in 2-3 days which I had to pay overdraft $35 each but my statement don't show i went to negative but they told me the money was on hold so I still gotta pay. I told them it wasn't my fault but the bankers, The first guy said no I will not reverse it and I called again but they say that they cant reverse it now because the previous guy put all no's and locked it. The bank wont give me $105 back that was not my fault, can I do anything?

The core issue has to do with, "When you deposit a check, how much of it is actually made available to you?" Technically, your funds aren't truly available until the check is settled between your bank and the other party's bank. If your bank makes a certain amount available to you earlier than that it is technically a loan to you. It's actually rather complicated. But the bottom line is that to truly be able to use funds on a check you deposit, you need to wait for the check to settle. In this case, you had outstanding checks clear against unsettled funds. All that said, it sounds like Bank of America should be flexible in your case. If you really want to get serious about getting the $105 back, I suggest you do the following: 1) Be prepared to open an account with a different bank. 2) Walk in to your BofA branch and sit down with someone (don't use the tellers). 3) Don't give them a long story. Just tell them that there was some confusion on your account which led to overdraft charges; ask the person to review the situation and to consider reversing the charges and for them to explain to you how to avoid this in the future. Then wait for them to review the transactions and answer any questions they may have. Be polite. If they don't compromise to your satisfaction, then ask them in a calm but firm tone to please close the account. If there was any chance they would start singing a different song, it would be at that time. If they don't compromise, then they are probably not worth your business...?
