Can I get my daughter back if I signed a Power of Attorney paper but didn't go to court to get it notarized?

Im trying to get my daughter back from my uncle and aunt but the thing is I signed a Power of Attorney paper saying that my uncle and aunt could take her to her doctor and daycare while I was in Germany for 3 years but I want her back now but that paper was not notarized in court or in front of a witness and I was wondering can I take her if a cop escorted me to there house,plus I can't afford a lawyer and I went thru Legal Aid and they said that I could pick her up anytime I want because no court was involved. Can I take my daughter without going to court and everything getting messy?

Yes you can was you just there living , working , Vacationing ? I would say think of your daughter also she hasn't been with you for 3 years she may not understand i would try to do this as civil as possible : ) Goodluck !

The Power of Attorney did not convey guardianship. Follow what Legal Aid told you but keep your daughter's best interests in mind. If you have been gone for three years she will need an adjustment period before she is ready to leave her present home. Try to find a free counselor who can help all of you make this adjustment.

It doesn't HAVE to be notarized in a court or in front of a witness. ANY notarization works, that IS your witness. If you didn't turn CUSTODY over to them, you can go get her. Although I agree with CAR - three years is a HECK of a long time to leave a child, and it's VERY possible that aunt & uncle have SINCE taken some kind of action to get legal guardianship of her. That wouldn't be related to the paper you signed, though. You also should give some thought to how your daughter is going to feel about this - if she was very young when you left her, from your daughter's point of view, you'd be taking her away from the only mother and father she's ever known. If she was older when you left her, she's probably having very strong feelings about you leaving her.

After 3 years your Aunt & Uncle may call Child Protective Services and say you abandoned your child. You need an attorney.

First, POAs are not notarized "in court" at all. Courts have nothing to do with it. Second, a limited POA allowing them to take her for medical care and daycare does not grant custodial rights. You left your daughter in the care of others for three YEARS? Are you sure you didn't sign some other custodial agreement?
