Settling Your Injury Claim with the Insurance Company?

  • Hello, I was wondering if anyone has any experience with settling your injury claims? I was hit about 3 months ago and suffered a mild concussion and WADIII Whiplash. I was in physical theraphy for this time due to numbness in my arm and face. The numbness has subsided and I'm left with some tightness that my Doctor says I should have for about a year. I wanted to make sure I was offered a fair settlement when I settle. Does anyone have any expertise in this area. Thanks

    Expertise? I guess I do. I was rear ended and had what I thought was "whip lash". The doctors all said it would go away. I was referred to physical therapy. I couldn't do it. They referred me to a pain specialist, and she finally ordered an MRI for my neck instead of just xrays. There it was, my c-3 disc was actually protruding a bit from the accident. I hired a lawyer, and was awarded policy limits of $50,000. Before you try to settle this, make sure you have an MRI to be sure you have no permanent damage to your neck. Doctors love to just "dump" you into a "You'll get better soon" pool. Don't fall for it, get checked out. If you have permanent damage, this claim just went from the low ten thousands to the other guy's policy limits. I did use a lawyer,as the insurance company and the other driver had to be sued to pay. Good luck. You only get one shot at this, as once you settle, you can never go back for more money.
