Question on CA health coverage--I accidentally waived my 2009 health benefits--can I reinstate them?

I accidentally waived my health care coverage through my employer. I have Kaiser and have had it for a few years through the same employer. I have worked at my company for years. I will ask my h.r. rep on Monday if my benefits can be reinstated. Kaiser said on their end that they probably can reinstate them, but since I asked them on a weekend, they couldn't tell me if most employers usually allow their employee's benefits to be reinstated. I already passed my open enrollment period in 11/08. Please help. Can I reinstate my health benefits before 1/1/09? Thank you.

Wow. Honestly, I was going to say no, I've never heard of this, but you said someone at Kaiser said maybe. So they're more positive about it than I am.

Was it a true "mistake" opting out of health benefits or did you think you were going to have them elsewhere for some reason? (maybe you were going to pick up benefits w/ your husbands policy or something?) I would think that considering the 1/1/09 effective date hasn't passed, you may be able to talk to someone who can reinstate you. If you thought you were having some type of change (i.e. you were getting married, now you're not, etc.) I would submit a request under the "qualifying life change" rule that allows you to change your benefit selection.

Due to IRS rules your employer is technically not allowed to let you sign up at any time. If you can show that you didn't understand or thought you had signed up but it turns out you didn't you could get an exception. Don't be surprised though if they deny you. If you give you an exception they are doing you a big favor.

~~If it is okay with Kaiser, then hopefully your H.R person will help yo out. If you had no usage during the off time I think they may be more apt to reinstate you. If you did have claims, it may be much harder.~~

Doubt it. The company handbook should spell it out. Only life altering changes can cause an amendment to the health plan
