Does my husband need insurance for a pest control business?

  • My husband works for a pest control business as a technician. They mainly deal with killing mosquitoes. Anyway, his boss has way too much work. More than he can handle. He's told my husband that if he wants to, he can work on the side on the weekends for himself, spraying peoples yards for mosquitoes, since obviously there's a lot of work out there, and he won't be competing with his boss because there is so much. It also won't be connected to his boss's business in any way. My husband has his pest control license in our state, TX, but he wants to know what all he would need to do to do this side business? I know he needs his DBA, but will he also have to get some kind of insurance? Anything else? Thanks!

    To keep that pest control license in TX, he MUST have general liability coverage with a pesticide endorsement - clearly, his boss is currently covering him under HIS policy. He's going to need to buy his own policy, to LEGALLY apply pesticides in TX. That coverage, for a single man operation, is going to run around $1500 a year - up front. NO payments.

It always helps to have cover but if you are unsure you should contact an insurance agent who will be able to advise you and what insurance you need and what level of cover you require.

The Texas Department of Agriculture requires evidence of financial responsibility (i.e. insurance). Have him check out Texas Administrative Chapter 7 Pesticides - §7.23 Applicator Business Proof of Financial Responsibility. When he was working as an employee he would have been covered under the employer's liability policy. If he does it on his own he will have to get his own insurance.

BEFORE he does the side work, talk to a insurance agent;;;;;;;;;;;; If anything goes wrong, regardless if he is responsible or not, if no insurance, they can go after your husband and you for any assets you have. As an employee, they go after your husband's boss/business. We live in a sue happy world. Don't delay. good luck
