Getting health insurance, can they access mental health records?

  • Several years ago I was diagnosed with OCD by a psychiatrist. I haven't had any treatment for it in over 3 years. When I apply for health insurance, do I say I have a pre-existing medical condition of OCD even though I no longer want treatment for that? Can the health insurance company find out I was diagnosed with OCD in the past, or are mental health records completely private? Once again, I don't want treatment for OCD or anything mental, but I also don't want my insurance quote to be higher by telling them I was once diagnosed with OCD especially since I am no longer seeking treatment for that.

    Yes, they can check. If you do not list this, and you later have a claim -- for anything, even something totally unrelated -- that is big enough, then they will check and they will find out about it. They can then refuse to pay all claims, because you did not tell the full truth on the application.

Yes, they can. You will have to disclose this preexisting condition when asked about it on the application. Your coverage is only as honest as you are. Lying on the application, will void your policy, when they find out. Then, you'll be complaining that you lied to the insurance company, got caught, and that makes THEM the bad guys.

If you had any health insurance related claims ever they are on file at MIB every insurance company belongs to MIB and have access to your entire history
