I've been getting too many frequent headaches! What's wrong here?

8 months pregnant and involved in a minor car accident.having headaches and neck pains.whats a fair settlemt?

    No rush to settle if you're pregnant. Might as well wait until after the delivery. Don't settle until you feel you've reached the point of "maximum medical improvement" meaning the point where you're either recovered completely or as good as you'll ever be. Make sure you find out what the statute of limitations is in your state so you know how long you have to settle. Having the clock run-out trumps everything else. Remember that if your health insurer or some government entity paid out on your behalf for the medical bills then they usually get dibs on your settlement. It's a bummer to settle for $500, spend it, and then get a letter a couple months later saying you owe your health insurance company the $500 back. And yes they can take you to court / collections over it. So make sure you understand who-owes-who-what before you settle. The amount you settle for is at your discretion. Different people place different values on such things and different states have different laws and different levels of litigiousness. What's worth $200 in Ohio might be worth $1500 in California. What's important is that you're comfortable with whatever you get. Don't base it on what other people tell you they got or what you should have gotten. You'll always be able to find somebody who'll tell you you didn't get enough.

If there is no possibility that the baby could have been injured or that the accident will cause premature birth, then a typical settlement is exactly the same as if you were not pregnant, so $250-$500 according to what he said.

I would definitely not settle at this time. You have no idea right now what kind of medical expense you will face treating the headaches and neck pain. Being pregnant adds to the urgency to not settle. You will want to make sure your child is ok as well! Insurance companies are wanting a quick settlement to limit their losses, but if these things linger, you will want to make sure you can be treated out of their pocket, not yours. Also make sure your car is repaired to your satisfaction.

The least amount to get is enough to cover all your expenses. Dont settle too soon.

If you're hoping for $10,000, it's not going to happen. When *I* got hit in a car when 8 months pregnant, my car had $6,000 of damage (it was a Saturn Ion - small, so it was a bigger accident than you had!) and MY settlement including medical bills to get me checked out, was a total of $1500. So yours sounds totally in the ball park. If you wait until AFTER baby is born, if baby is born with NO injuries, then your settlement drops back to $250 to $500. The only reason they're willing to throw an extra $1000 at you now, is just in case, there's something wrong with the baby. Most likely there isn't, but that $1,000 buys you off being able to sue them later.
