Can I refuse third party insurance to write off and get them to pay for the repairs ?

Got hit in the rear by third party who admits responsibility. Using albion assistance to get car repaired and claim back from third party. They have gotten back to me saying it costs 2300 to fix which is slightly more than their valuation of the car (according to them). The car works fine. Just some minor damage to the bumper and a few things beneath which apparently cost a bomb to fix. I don't want to write the car off as its still drivable. Can I refuse to settle and get the third party insurance to pay for it even if it costs more than the value of their car? (I don't really want to settle and get car fixed myself)

Ask them to pay you £2k and you retain the ownership of the car. Make sure you don't have to pay any of the towing or storing costs.

Not sure how things work in the UK but in the US a" third party" insurer pays you directly for the damage or value of the vehicle and it is up to you to repair it or not. If it is considered a total loss they will usually give you the actual value of the car less the salvage value and let you keep the damaged car. Good luck

if the accident was not your fault, and it never is if you get hit from behind, you should seek legal help from an organisation that specialises in dealing with accidents that are not your fault and they will help you to get a new car that is identical rather than what they decide it is worth. these organisations take their fees from the other persons insurance so it wont cost you a thing

You can get the payout and buy the car back for the salvage value. This is just how it works, it will cost more to fix the car than it is worth.

you can make an offer to the insurance company to buy car off them often they will accept an offer lower than value it is in there interest.
No It may well be driveable but that dont mean its road legal or safe However you say "they got back...." who is the "they"? You (or your insurance) should be dealing with their insurance the value of THEIR car is irrelevent to whether your car get written off. Its the value of YOUR car that matters. NO insurance company will pay more for repairs than the value of the car. So if the repairs to your car cost more than its worth they will only pay out what its worth (and that aint what it costs to replace) (And just cos you get hit from behind does NOT AUTOMATICALLY mean the other guy is responsible. There ARE circumstances where the guy in front can be responsible)
